residential home closing
I am unavailable for the Contract Settlement Date, and Seller refuses to change the date, even one day. There is no ''time is of the essence'' clause. Will I be in default for failing to close on the Contract Settlement Date

Since you agreed on a specific date, that becomes a contract requirement. It seems strange, especially in this market, that the seller is being so inflexible, unless he has his own purchase closing tied into yours. Offer to come in early and sign if you are unavailable on the exact date. Alternatively, give a power of attorney to someone who can attend on the settlement date.
