Sale of Property

My uncle is in the process of subdividing property into 2 lots, one which he will keep and the other he is selling to me. The subdivision plan is being submitted to the county on Tuesday.

My uncle needs open-heart surgery and is scheduled for the procedure on Monday. He is very concerned that if he does not have a legal document, the subdivision and subsequent sale of the property will not occur.

What must he do to ensure that his plans are carried out?

If there is a concern that your uncle might become incapacitated following his surgery, he can execute a durable power of attorney, authorizing someone he trusts to act in his behalf. This can be limited to the specific transaction, or it can be more general, depending on his needs. I strongly recommend you have it prepared by an attorney experienced in these matters.
