Legal Question in Real Estate Law in Maryland

Security System after close

At the closing buyer stated that he would pick up service contract of security system. Buyer has failed to get service. In the contract security system was marked. Security company wants me to pay for equipment because new owner did not get service. Any recourse in getting system out of house.

Re: Security System after close

You should be able to have the system removed from the house if the buyer has decided he doesn't want it. In hindsight, it would have been a good idea to stipulate in the contract that the security system conveys on condition that the buyer assumes the contract, especially since you don't own the equipment under the terms of the system agreement.

You should write the buyer and advise him that you want to make arrangements to have the system removed unless he wants to buy the equipment and keep it intact in case he later decides to activate it. Since you didn't own the equipment at the time you conveyed the property, you couldn't legally convey ownership of the system to him in the transaction.
