Legal Question in Real Estate Law in Maryland

My ex spouse and I co-owned a home which is currently in forclosure, although the bank is taking their time actually forclosing. The last house payment was made in Dec 08 and the home was vacated in Sept 09. In Oct 09 I filed for Chapter 7 Bankruptcy which was granted in Jan 10. I have just been sued for past HOA fees. Am I still responsible? The home was included in my BK, but not specifically the HOA.

Thank you.

You are liable for HOA fees from the bankruptcy petition date through the foreclosure date. There is an express provision of the bankruptcy code that provides that post-petition HOA fees are not discharged.
