Tenant Rights

I'm currently living in a basement apartment in a private home. The landlord lives in the home. I do not have a written lease, so I guess I am a month to month tenant. I would like to know what my rights are and what is the landlord responsible for? I have an issue with him regarding sufficient lighting of the entry way of the apartment. He claims the light is on a timer but it very rarly comes on. I've asked him several times to fix the existing timer or get a new one and he claims to have corrected the problem. Also does he have a right to have a key to my apartment? Thank you for your assistance.

Since you don't have a written lease, it's difficult to give you a precise answer as to the "lighting" issue. Generally speaking, you are entitled to reasonable enjoyment of the rented premises, which implies adequate lighting. If this is a safety issue, the landlord has a certain duty to provide it. If the light is not working as it is supposed to and is an integral element of your rented premises, I think the landlord should fix it.

The landlord has no right to enter your apartment without your permission, except in the case of an emergency. That's where his possession of a key comes in. Suppose you're not home and there is a gas leak. The landlord needs access in such a situation. On the other hand, he's not entitled to come in to check on whether you're keeping the place clean.
