Legal Question in Real Estate Law in Maryland

Thursday, I sent a realty agency a $35 check to pay for my credit report as part of the application process. Friday, I was told that the rental went to someone else. I thought that it was odd a decision had been made so quickly since that seemed insuffient time to run the credit report and speak to my referrences, including my current landlord. Today (Wed), I saw that the check had been cashed Tuesday. My landlord also confirmed that the agency never spoke with him. So the agency cashed the check without processing the application. I think this is dishonest. Do I have legal grounds to request a refund even though the application states that the credit check fee is unrefundable?

If they didn't actually run the credit check, or if they ran it after the property was leased to the other applicant, which appears to be the case from your timeline, they should refund your money. Ask them for it back.
