If a tree is hanging over onto someone's property, who is responsible for trimmomg the tree?

If the tree is healthy, the person who owns the property over which the tree is hanging may trim the tree back to the property line. If the branches fall and damage his property, the owner of the tree can't be held responsible. However, if the tree is obviously diseased and the owner refuses to cut all of part of it down and then it damages the neighbor's property, the tree owner is responsible.
