Legal Question in Real Estate Law in Maryland

We have a tree that is leaning toward our neighbor's house and would like to remove it for safety reasons but the neighbor won't let the contractor on her property to remove the tree. What recourse do I have to remove the tree? If there was a storm and the tree fell on her property would I be responsible?

You can't go on the neighbor's property without her permission, so any removal of all or part of the tree would have to be done from your property, if feasible. On the other hand, you are not responsible if the tree falls on her property, especially since you were prevented by her from removing it. I'd point that out to her; it may cause her to rethink the situation.
