Legal Question in Real Estate Law in Maryland
Victim of Theft
The hot water heater tank in the apartment that I rent recently malfunctioned, flooding most of my apartment, and destroying many of my clothes and valuables. The property manager, staff, and contractors are currently working to repair the damage. However, when I stopped by the apartment a few days ago to check on the progress, I noticed that several items were missing, including $1,500 in music equipment, and a $900 watch. There has been no sign of any kind of break-in. I am positive that these things were stolen by those working on the apartment repairs.

Re: Victim of Theft
Although you didn't pose a specific question attached to your scenario, I assume you are wondering who is responsible. You should have immediately reported this to the property manager and also filed a police complaint so that hopefully they will investigate. If it turns out that someone working for the contractor who was cleaning up your apartment is the culprit, the contractor might be liable if he failed to properly supervise his workers, but probably wouldn't be liable simply because he's the employer, since he couldn't be expected to foresee that someone would do this, unless it happened before. He might have some kind of liability insurance if you can convince them that it happened during his presence in your apartment. I assume you didn't carry renter's insurance.
