Who's Right and Who's Wrong

If there is no written agreement, and some rent is not paid when a tennant moves out, can he or she be taken to court over this matter?

Yes. If there was an oral agreement for payment of rent, and that rent was not paid, it is due at least for the period of actual occupancy. There is always a question of proof if the agreement is disputed.
