Legal Question in Social Security Law in Maryland

SS survivor benefits and child support arrears

I have 3 children who receive benefits due to their father's death. They have 3 other siblings also receiving benefits. One of the other mothers had filed for child support when her son was much younger. I have recently received notices from her state child support office indicating that they will deduct the child support from my children's ss benefits. Is there anything I can do to prevent this? I have spoken to the mother about removing her child support order and never heard from her again. What can I do?

Re: SS survivor benefits and child support arrears

First, Contact the Social Security Administration about the matter. I am not sure such benefits can be attached for a support arrearage.

Second, contact an attorney who practices child support law in your county. You may be eligible for Legal Aid, so start there.

You may wish to re-post the question under child support.
