Legal Question in Tax Law in Maryland

How do my sons file my taxes when I die?

I am 62. My income is Social Security and retirement from my deceased husband. I have to file taxes each year. I have made a will which lists my sons as executors. If I die, do my sons have to go through probate to officially become executors to file my taxes or can it be done through, say, a power of attorney or other instrument ahead of time? If they have to go through a legal procedure at my death, is there a quick legal procedure? Probate is time-consuming and paperwork-heavy and my sons do not live in this state. I hope there is a pre-death remedy. I would appreciate a response for both state and federal tax purposes. Thank you.

Re: How do my sons file my taxes when I die?

It is simple. They gather the information for your

income and expenses for your income tax return.

They appraise your assets and report them on

the estate tax return. Fortunately, you won't

be worrying about this any more!
