Legal Question in Tax Law in Maryland

spouse signed name on income tax form &now claiming innocent spouse relief g

My sister left her husband over a year ago. They have always filed a joint return. She has always made more money then he.Last yr, when she went to file, she then found out he already filed with her info and signed her name.Today, she called IRS to get info for her divorce. She then found out he filed innocent spouse relief and now he is no longer responsible for any unpaid taxes that he made arrangements for a payment plan. He claims he never really new how much money she made, which is a lie. They bought a house together, which you need income info on how much you make. She co-signed for his car, also income info needed.Again joint returns. How can he get away with this?

I would suggest contacting the IRS and explaining

the situation. You will have to prove what

happened, possibly by showing bank statements

or other similar documents. The IRS was required

to notify you of the pending innocent spouse

request and give you the opportunity to object.

If they did not do so, you can very likely

take action to correct the situation. Our firm

assists people in your situation all the time.

You may call us for a no-obligation consultation.
