Legal Question in Tax Law in Maryland

This spring my husband & I went to an advertised tax attorney to get help becoming current with our delinquent state & federal taxes. We paid him upfront & signed a power of attorney allowing him access information he would need to complete the returns.

After finding all of our info the returns were finally filed in the beginning of November. We've just found out that our state had an amnesty program the whole month of October forgiving penalty & 1/2 the interest for people who came forward & filed back taxes during October. When asked our tax attorney said that yes he knew of the program, but we hadn't asked about it, which is true, but that's why we hired an attorney for tax help. He also said of none of his [1000] clients had asked & he hadn't mentioned it to any of them.

Is this legal? He knew about our financial issues, when he accepted our money, but never even mentioned a the state program that would have saved us a bundle.
