Legal Question in Tax Law in Maryland

what is the statue of limitations on i.r.s. pursuing you for back taxes

I was assessed for taxes on a joint 1998 return with my ex-spouse. I was not aware until 2002 after our divorce. He signed my name and ''we'' owe 17,000. A Bankruptcy was filed 2002. It is now 2009. Do ''we'' still owe the money to the I.R.S. I am now remarried to someone else. This occurred in the state of Florida. Have the statue of lmitations ran out?

The Statute of Limitations is 10 years after the return is filed. However, the bankruptcy would have stopped the period from running while it was pending. The only way to know when it will run is to analyze the transcripts. At that time a decision can be made whether to wait out the time period or take affirmative action to relieve you of liability. If they are not actively pursuing you, it may be better to wait. Call me if you need any assistance. Steve Klitzner 18002191118
