Working away from home
My husband and I currently live in Florida. We owe our house. Both of us are working for the same company. Now we need to go to Maryland to do a job there (6-12 months). We already rented a furnished apartment,and the company reimburses the rent for us. And we will be traveling back to Florida quite often. We are not planning on selling our house, because this job is only temporary. My question is: We don't have state tax in Florida, do we have to pay it in Maryland? Are we still considered to be a Florida resident? Do we need to tell our employer not to change our residency?

You state taxes will be based upon your domicile election. Adjusting or informational returns may need to be filed based on how your employer pays you (e.g., W-2 or 1099). YOur Federal taxes will remain the same. At a minimum, you should have an attorney or tax accountant review your matter and compare the differences between Maryland and Florida with all things considered so that you can make an educated and informed decision.

'Domicile' is 'that place where a man has his true, fixed, and permanent home and principal establishment, and to which whenever he is absent he has the intention of returning.' I would suggest talking to a Tax Attorney for purposes of tax issues, and to insure that your homestead exemption in Florida is secured. We have a tax dept. here at our firm.
