At Fault Driver-Used My Name

A co-worker of my daughters stole her wallet and on the same night the co-worker had an auto-accident, which she was ticketed. Here's the question, somehow the ticket ended up in my daughter's name (she was not in the car, nor at the accident)but due to the theft of her wallet, her wallet was in the car. Accordingly to the co-worker, she is stating the officers retrieved the belongings from the car, while she was being checked by the paramedics, and they approached her and ask her address, she gave her own, they then handed her a ticket and license (which she states she did not sign the ticket) and did not realize until later, that it was my daughters license and name on ticket? Yeah Right... 1st off can she be charged with theft? (nobody seen her take the wallet) but it was in her posession. How and why would a state trooper not realize, that the person on the license they used to write the ticket, was not the person in the ambulance? What can be done about the officer's negligence?

We have contacted the state police, but the officer in question is on vacation and no one else has any answers.If we have to hire an attorney to clear this mess up, can we sue for expenses, both the officer/state and the co-worker ? Thanks

You should definitely consider hiring an experienced criminal and traffic defense attorney for this case. This charge likely carries a lot of points on your daughter's license.

I would also consider speaking with the State's Attorney's office in the county where this occured, because they may file theft charges against the co-worker and force her to pay restitution for your legal fees and any other losses.

If that doesn't work, you may consider a lawsuit.
