Re: hit and run

The matter of criminal charges is at the exclusive discretion

of the State's Attorney (SA). The SA will render the criminal charges

that it sees fit in the circumstances. The SA's decision will be based on

judicial economy and the evidence available to support the charges. The SA usually

does not charge for all infractions that are possible under the law as this is

not economical.

As for civil recoveries, you have several options. Depending on the evidence, the charges rendered

by the SA, whether the criminal charges are adjudicated to guilt or whether the ticket(s) is/are paid

in lieu of a court apperance, the extent of damage and availablity or non-availability of insurance coverage,

the insurance company involved, whether an uninsured/underinsured claim applies, and other factors affect your

ability to recover monetarily for your loss.

In such cases the assistance of an attorney is advised as there are numerous factors that can affect whether you

recover for your loss.
