Legal Question in Traffic Law in Maryland

Lights Off Strategy?

To whom it may concern:

I recently received a speeding ticket in Maryland. I was coming over a hill and the county sheriff was sitting on the opposite shoulder of the road with the lights off. I have not been able to find any good information as to whether this strategy utilized by the county sheriff personnel is legal here in Maryland. I know it is not a legal method of catching speeding motorists in many states.

Could you enlighten me as to whether this is an acceptable and legal method of clocking speeding cars in the state of Maryland?

Thank you for your time. Have a nice day.

Re: Lights Off Strategy?

Police officers can utilize any strategy available including trickery. I am not aware of any state that holds differently. Representation is advisable where you would like to avoid points. Speak to an attorney.

It is legal for the police to hide in an attempt to catch a motorist speeding. However, a good lawyer, like myself, might find other things the officer did not do correctly, or may be able to mitigate your speed before the Court.
