Legal Question in Traffic Law in Maryland

Speeding Ticket

Sheriff said I was speeding according to the radar gun. I was going up hill at the time the radar gun was pointed at me. The Sheriff was hidding on the opposite side of a civilians home drive way. I received a speeding ticket and 2 points on my license. I would like to get the points taken off. I want to go to court to ask to have the points remove. Is this a smart approach to have the points removed? Can the Sheriff hide while using radar gun? Is this a speed trap?

Re: Speeding Ticket

It sounds like a speed trap, and a pretty good one. That doesn't get the ticket thrown out if that's what you are asking. A speed trap is not illegal, it's good police work. If you have already went to court and now want a PBJ (Probation Before Judgment), you have 90 days to file a motion to reconsider your sentence. Otherwise, if you have not yet gone to court, just show up on the trial date and ask for PBJ.
