Legal Question in Traffic Law in Maryland

Could I be sued for hit and run?

I was involved in an accident recently. It was my fault. And I was so shocked at that time that I did not stop. But furtunately the other driver was able to stop me soon. We make a deal to settle it privately. No police was called and we did not call our insurance companies. I paid the other driver for damage and I made him sign an agreement to release further claims. But if the other driver decides to chage his mind, could I still be charged with hit and run?

Re: Could I be sued for hit and run?

You can be sued for anthing. With the help of a good lawyer, you should not be found guilty. The purpose of the statute is that you give the other side your insurance information. In your case, not only did you identify your self, but you settled the suit. Therefore you complied with the statute. Should you be charged, please give me a call for representation.

Re: Could I be sued for hit and run?

It is possible that you could be charged with hit and run. With representation

you stand a reasonable chance of having the charges dismissed or being found not guilty or otherwise

not penalized. Of course there are no guarantees. The chance of you being charged is small in that you

provided the information needed by the other driver. As to whether you could be sued for personal injury or other causes of action, this would be a civil matter.

It probably would have been a good idea to get an attorney involved when effecting the release. Although not a definate, it is probably not a good idea to re-open that matter unless your release is highly deficient.
