Sueing for compensation after accident

A man drove off the road and ran into the front of my car, which was parked,pushing it 25 feet from where it was parked.My car was parked perpendicular to my husband's and was pushed into the side of his. All three cars were totaled.No one was seriously hurt.

The man received no tickets,even though he was speeding and was not carrying his license.Shouldn't he have received a ticket for reckless driving or driving without a license?He was allowed to leave the scene before we were finished,and the police later went to his house to finish the accident report,resulting in inaccuracies.

Because of the accident, my husband and I are going to have to pay approximately $4000.Can we sue the man responsible in order to get this money back?We were told that it wouldn't be worth it because of lawyer fees,but how else are we supposed to make up for the money that will be lost by absolutely no fault on our part?

I have suffered from clinical depression for years. As a result of the stress from this accident, I have greatly worsened in the past few weeks, resulting in behaviors and tendencies I previously had under control.My psychiatrist suggested I sue for mental anguish. Do you have any thoughts on this?

First, your insurance company should be paying for your car. Second, you should sue the driver for damage to your car, although your insurance should also go after him to get your deductable. Finally, you can hire an attorney, like myself, who would pursue the claim for you, including the use of a rental car until your's is replaced. Most lawyers will take the case on a contingency fee bases, that is they do not get paid until you recieve money. This fee is usually 1/3 of the amount recovered.
