Legal Question in Wills and Trusts in Maryland
estate
My grandson is the only heir of his father. His father recently died and an uncle is now saying that the grandson will get nothing. His father had cancer and was moved to wv right before he died.
also supposely there is a bank account with the father's name and the father's mother's name. Who gets this. The estate is very small.

Re: estate
The answer to this question depends on the answers to a number of other questions! If your grandson's father was living in West Va. at the time that he died, his estate will most likely be handled in The West Va. Courts. If your grandson is the next of kin but his father made a will naming the uncle as sole beneficiary, then your grandson may have the right to contest the will-especially if his father's will was changed while he was very sick and there is a question of competency.
Unfortunately, will contests etc can be time consuming. If there is not much money, it may not be financially worthwhile to pursue such a claim. In any event, you or your grandson should talk to an attorney directly and it may be that it should be a WV attorney. Feel free to call or otherwise contact me if you want to discuss this in more detail.
Good Luck!
