executor of estate

My father just passed away ,my brother has been caregiver and power of attorney for last two years.Can I tranfer executor of estate to him some way? Would be much simpler since he has been dealing with his banks etc for last few years

First, I'm sorry for the loss of your father.

The duties of executor are non-delegable -- that is, you can't assign them to someone else. Depending who is listed as backup executor in the will, you may be able to refuse the position or resign if you have already been appointed. If there is no will or if nobody else is listed, you could still refuse or resign depending on who is surviving your father (how many brothers, surviving spouse, etc.).

In Maryland you and the other interested parties, may sign a Probate Form consenting to the appointment of your brother as personal representative (executor)
