Legal Question in Wills and Trusts in Maryland
How to file a Lien against an Estate?
The company I work for has an employee who passed away within the past 60 days and the company had loaned her quite a bit of money. What does the company need to do to file a lien against this persons estate to try and "recoup" some of the monies that were borrowed?

You must call the Register of Wills office where the employee resided; see if an estate has been opened; get an estate number, and a claim form; get the name and address of the Personal Representative and file the claim with documentation with the PR and cc the Register of Wills office.

You should contact the Register of Wills office for the county in which the deceased lived and request a copy of the form for filing claims against the estate. Complete and return the form. It is important that this be done as soon as possible, because the statute of limitations for filing such claims is very short.
