Legal Question in Wills and Trusts in Maryland

Who gets the house

Several years ago my husbands grandmother wanted to refinance her house. She asked him to go on the loan with her because she wanted the house to stay in the family if something happened to her. Upon her passing does the house automatically go to him? If not what does he need to do now to insure that it does since there are other children involved?

Re: Who gets the house

1. Check the title on the house! Who owns it?

2. Recheck Grandma's will! Make sure your husband is listed as the beneficiary of the house.

3. Make sure the title of the house includes your husband as "joint tenants"! Hope I've been helpful to you...

Re: Who gets the house

The answer is going to depend on how settlement was

handled. If your husband can't get hold of the

records from his grandmother's house then he should

go to the land records office in grandma's county and

do a quick search for her name in the records. If he's never done a title

search, ask the people working there. Depending on

the county their attitude will range from indifference

to a real desire to help, but in any event they will

help out. What

he is looking for is a deed that (hopefully) names

him as a joint tenant in the estate. If he only finds

a deed with her name on it as a result of the refinance

then he will need to do a little more searching.

He should also try to find out if there is a will

since that will make a huge difference.

Good luck.
