Legal Question in Wills and Trusts in Maryland

modified administration

Could you explain what ''modified administration'' is? I am personal rep for my dads estate, there was no will and I am the only child. There is no one left but me (Mom died in ''03). I really don't understand the wording that explains this procedure. The 3 month deadline is coming for the inventory, and if I can get out of doing it,, that would help. Thank you

The Register of Wills Office (at least in Montgomery County and probably in the county you're dealing with) has always been happy to help clear up any confusion. I've done modified admin estates before, and, if I remember correctly, it concerned less stringent reporting requirements if the estate was going to only certain family members (children of the decedent in my case). But don't take my word for it, ask the register of wills staff!

I am very sorry to hear about your loss.

Modified administration is a streamlined process that dispenses with filing an inventory and account in favor of filing a "Final Report" within 10 months of being appointed personal representative. There are some other requirements, such as actually closing the estate within 13 months of appointment.

If you are the only remaining residuary taker, as a child of the decedent, you may qualify for modified administration. Here's a link that may help:
