Legal Question in Wills and Trusts in Maryland

i have been given notice to appear at a distribution by court of an estate in frederick county, md. one of my sisters is apparently renouncing her share of the estate. one lawyer has told another of my sisters that if the sister in question does not show up at this proceeding, the money goes to the frederick county, md board of education instead of the other distributes of the estate. is this correct.

No, that is not correct. Depending on the language of the will, if there is one, If your sister renounces, her share should flow down to her children. If she has none, that it should go to her siblings. The only time i would go to the BOA is if there were no ascertainable heirs.

Due to your receipt of a notice of distribution, it appears that the last will and testament is being questioned by the court. Although I have not had a last will and testament result in such contest I have defended wills written by other attorneys. Another avenue may be intestacy.

I am available to assist the family with probate and can provide services where a beneficiary opts to disclaim an inheritance. Contact me for legal assistance.
