Legal Question in Wills and Trusts in Maryland

Pennsylvania Will still effective in Maryland

I am retiring later this year and relocating to Bishopville, Maryland (Worchester County). My will was originated in Pennsylvania ... do I have have to have my will changed once I relocate to Maryland? The same question applies to power of attorney and living wills?

Generally, such documents are valid in any state

if they are valid in the state where they were

executed. It probably would not hurt to have the

documents reviewed for Maryland law compliance,

especially if you intend to live here. I do not

practice law in Pennsylvania, but I know of no

substantive differences between the law of the two

states which would necessitate changes.

I am licensed in Pennsylvania and agree with the Maryland attorney. There are no PA laws that are affected by this. The state in which you reside upon your death will have the governing law, assuming that is Maryland you will need to make sure your Will meets Maryland guidelines for execution, (ie: some states require two witnesses other do not).

The living will and POA will be looked at under Maryland law and you should have a Maryland attorney review them for compliance.

Each state has specific requirement for POA and living wills.
