Probate Queation

My sister was executor of my mother's will. My mother did not own any property when she died and was in a nursing home. My sister said that there was no probate because she didn't own anything. My mother received asbestosis lawsuit money for my father who died of asbestosis. She now tells us that my mother is not receiving any more asbestosis money. If there is asbestosis money coming in, shouldn't there have been a probate done? Also is there a way to find out what asbestosis monies have been paid out and when?

MD law requires that the custodian of a document appearing to be the last Will of the decedent to file it promptly with the Register of Wills in the county where the decedent was domiciled at the time of death. There are MD estate administration issues that need to be carefully considered and dealt with after full development of the facts and circumstances here. There are certain time periods that are applicable for administration of a regular estate in MD. An experienced estate planning/administration attorney should be able to handle this under MD law.
