Legal Question in Wills and Trusts in Maryland

Right of refusal cocerning property

In my grandfathers will he stated that my uncle, his son, has the first right of refusal to purchase his house in the event of his death, which has occured, giving me second right of refuasal. If my uncle does decide to buy the house, does he have to live in it, or can he buy it and sell it to another family member ( his son) preventing be from buying the house, and eliminating my rights?

1. Read the Will! The answer may be there...If the will is silent, he can do what he pleases with it...remember, this is a gift..

Without reading the will first I can't give a

definitive reply, but chances are he can do with

the property as he wishes once he takes it. Part

of property ownership is the right to sell it as

one wishes. If there are no restrictions in the

will, then he is probably free to do as he sees fit.
