Legal Question in Wills and Trusts in Maryland
My son died 3/17/12 with no will or beneficary on his life ins policy at his p.s. teaching job.me and my x wife( his mother) was his only surviving relatives.he died owing about $20,000 in debt credit cards,loans etc. will his ins policy be sized to pay his debt.thanks steve

I am sorry to hear of your son's passing.
An estate will need to be opened... the life insurance policy will not likely be "seized" but with no beneficiary identified it may need to go into the estate and be used to pay estate bills and certain creditors who properly assert claims. The law gives certain priority for paying claims when an estate doesn't have enough money to pay everything, but the creditors rights are not automatic.
