Legal Question in Wills and Trusts in Maryland

Successor Executor

I am the Successor Executor and my father is the Executor of my grandfather's estate. Can my father sale my grandfather's house without my knowledge or statement saying that I concur with the sale? I have a copy of the will which states I should recieve 1/3 but I do not wish to sale the house. What happens of I pursuit the route of ''Less pending''?

Re: Successor Executor

As executor, your father is the named individual in your grandfather's will who has been designated to administer your grandfather's estate. Your father's principal duties are to inventory and collect your grandfather's assets, to manage your grandfather's assets during administration, to receive and pay the claims of creditors and tax collectors, and to distribute remaining assets to those so entitled under the will. Since he is responsible for managing the estate, including the disposal of assets, any thing short of that would be a breach of duty.
