Legal Question in Wills and Trusts in Maryland

what to do about a unread will

This involves my father-in law who's adoptive mother has recently passed away. He is in Maryland right now and his stepfather cannot find the key to her safe deposit box where the will is located. It seems very convenient that her widower cannot find the key. Does my father-in law have the right to have the deposit box opened? Furthermore his name was on her checking account as p.o.d. for more than 20 years, until this august when her widower convinced her to take it off. This action was done well after she was diagnosed with alzheimers. What can he do? Oh! Father-in law's name was on the account before she married this man. If that makes any difference.

Re: what to do about a unread will

Any will that is made with an infirm mind is voidable at law. The burden lies on the party seeking to have the will rescinded. Upon recision the will may revert to intestacy law. A caveat contest of a will is moderately complex. Contact an attorney. (410) 619-5918
