Legal Question in Wills and Trusts in Maryland

No will

My mother just died Saturday January 24th. She was 48 years

old. She has been divorced from my

father for over 15 years and had

never remarried. My sister is 26 and

I am 24. We are her only children.

My mother was a woman of modest

means. The only things of value are personnel items she had in her

apartment. I over heard her sisters

and mother talking about splitting

up her personnel things. I don't

think they have a key to her

apartment but I wouldn't put it past

them to break in. What are my legal

rights. I don't think I can go up

against all of them in my mental

state. They are a pretty ruff group.

I don't want to alienate myself from

the whole family..... Please Help!

Re: No Will

Even though she does not have a Last Will and Testament, she has a one of sorts and this is called an intestate will. Please see some of my other answers for further information. In short, an intestate will is how her belongings will be divided in accordance with Maryland's statute.

Important to your mother's affairs is ensuring that her assets and finances are applied to attend to her final affairs (e.g., burial or cremation, bills, etc.) Those who loved your mother should recognize these needs.
