Legal Question in Workers Comp in Maryland

back injury

Workman's comp is sending me to their doc. for a second opinion. My second surgery was scheduled for this wednesday when they informed my doctor that it would have to be cancelled. I have been working but in pain. Can I legally stay off work until the second doctor sees me. And does workman's comp pay me for those days off?

Re: back injury

If you have been working leading up to the surgery, then they won't pay you for the delay. If you've been receiving temporary disability benefits in the interim, they will have to continue paying those benefits until you've either had the surgery or until you've recovered enough to resume full time employment.
