Legal Question in Workers Comp in Maryland
back surgery
I made a settlement on my back injury with the understanding that I would not come back for any more compensation and the insurance company agreed topay for all related costs. This case went to workers comp. court and the insurance company was instructed to pay all costs involved. Now I am having a hard time getting my medication paid for. Does this negate the settlement I signed or can the insurance company do as they please with no recourse from me.

Re: back surgery
If your settlement was a "full and final", then the insurance company is not obligated to pay for any further medicals. If you settled for compensation only and reserved on medicals, then they must pay for all medications prescribed by your physician for the related injury. If they have rejected paying for medications they must give you a reason for doing so. Your recourse is to request another hearing to get a commissioner's order for them to pay. In no way is your settlement negated.
