Employer's responsibilities to employees suffering from job-related injuries
A secretary of a local school system was assaulted by two parents. She was punched in the face, pushed to the ground and kicked about the neck and head in the school's main office. The school sytem provided physical therapy for the neck injury. Two sessions of counseling were also provided and the secretary was instructed to return to work two weeeks after the incident. The secretary was given sick leave pay for her two week absence. Should the school system have to further compensate the secretary for pain and suffering?

The secretary is entitled to compensation under the worker's compensation law from her employer (or its insurance carrier). This includes 2/3 or her gross pay for as long as she is disabled from working as certified by her doctor and payment of all medical expenses necessarily incurred as a result of the injury. If she was unable because of her injuries to return to her former job, she would be entitled to be retrained for another position, but that doesn't seem to be the problem here. If she received a permanent disability or scarring because of this event, she would be entitled to additional disability benefits.
