Neck surgery for herniated discs... how does this effect my case?
I injured myself at work in Sept. '05, I have something wrong with my right shoulder (dominant arm), and have 4 herniated discs in my neck. I was just seen by a neurosurgeon who says I need surgery on my neck to replace C5-6,C6-7 (?) and this is the cause for all my shoulder/ radiating arm pain. We (the many dr's I have seen) have all known the results of my MRI since 2 mths after the accident, and now I am just hearing about surgery? My question is.. I am in alot of pain and am really scared about the whole neck surgery thing.. does it mean I will get less money because my problem was partially repaired? Or will they have to pay alot anyway for all my pain & suffering through these past 17mths? I already had an IME appt and even they agreed something was wrong, but my WC carrier still filed issues,, and of course I won in court.. the proof was all right there.. as it still is. I am just so confused on what to do. WC is ready to just pay for the surgery, I called today requesting authorization for a second opinion.. and they didn't seem to eager to have it done. They say I may need the surgery on my shoulder too, we will see if the surgery on my neck fixes the shoulder problem.. It is just a big mess.. I just want my life back.

The amount of payment in a worker's compensation case is based on your % of disability AFTER you have had all possible medical treatment for your injuries. You should have a lawyer to assist you in this complicated case to make sure you recieve the highest per cent of disability you are entitled too.

from your question it appears that you don't have a firm grip on how workers' comp. works. i would suggest you call my partner bruce ingerman who can fully inform you of your rights and options
