Non-Payment of Wages

I took a position as manager with a small real estate agency/mortgage lender in August 07 and was supposed to recieve $600/week and $1000/week after obtaining a license to operate as a mortgage loan officer. I was paid 5-$600 payments, of which he wrote ''Draw'' in the lower left corner of the checks.

Though I had requested a written agreement be drawn up, i only recieved week after week of excuses and delays. I was almost ways in by 9:00 am and rarely left before 8:00 pm, often to go home and make calls, worked most Saturdays and some Sundays. I obtained my mortgage license October 27, 07 and he failed to pay me as agreed.

Though, i tried to make things work, and gave the employer every benefit of doubt, he did not pay me and he made it increasingly difficult to continue, and i finally left in December 07.

I seek payment of wages, perhaps damages for non-payment, any other possible remedies available.

You can file a wage and hour claim but it will be difficult without a written agreement or a track record establishing that you were on a salary as opposed to a commission-based draw. That will obviously be the claim of the company's owner.
