Legal Question in Workers Comp in Maryland

was just released to go back to work

i still have pain in my foot and the dr. said although the fracture is not healed I can return to work 4- 7- 2008. Can I get a new DR. under the same workers comp. claim? And if so do they still have to pay me for being out of work.

The insurance company probably won't agree to pay for a second opinion as part of your comp claim. It sounds like you went to a doctor steered to you by the insurance company or employer, rather than one you chose on your own. Schedule a follow up appointment with your dr., so if after a few days' work, you have increased pain, you can report that to the doc and see if he will reconsider his work instructions.
