can a structured settlement be assumed if recipient agrees to it

I don't know what you mean by the word "assumed", but if both parties agree to a structured settlement instead of a lump sum payment, and the workers' comp commission approves it, it's permissible.

If both parties agree then there is no assumption. I would not assume anything but rather want all details so that an assessment can be made as to adequacy of any offer to settle.
