Time Frame for WC

Is there a time frame for workers comp? Example: injured on Jan 1 2002 out of work as of then, is there a time frame weekly payments can be paid before a dicsion has to be made do something to employee ie. terminate, retire, retrain for new or other job, etc. or can I do any of these things? of course this is assuming that person can't return to same position.

The law and procedure relative Work Comp accidents is much more technical than many people think. Although it would be impossible to give you a complete exposition, I'll simply tell you first there has to be an Employer's Report of injury where the worker is disabled more than three days. The ins. carrier has to get involved. They have to determine if the "injury" is in fact compensable. Of course, all this time the worker believes the insurance is her best friend; they are taking statements,sending the worker for "independent" evaluations and at any given moment they drop you or they screw out of benefits. although you don't know what benefits because you don't have a clue what your rights as an injured worker are. The first rule about insurance companies, don't pay a dime if you don't have to. They are not working for you. Attorneys like myself take these cases for free, we advise,counsel and represent to insure the worker gets all the benefits the law provides such as medical, vocational training and rehab, etc. A lot of injured workers come to the lawyer after the worker has given away the store with improper answers or waivers, much like an accused in a criminal case. There may come a time in the recovery when you and your doctor (not theirs) realize you may not be capable of the same job. What then?
