Work related injury What is Next?
One Wednesday Oct 17th I dislocated my left knee while at work. I went to the ER immediately and was given a work release until the 22. On the 21 I returned to the ER because the swelling had not gone down and the pain was worsening. The ER dr said that there was fluid in the knee and I was in need of an orthopedic dr. I made an appointment with my Primary physician and seen him today Oct 23. He ordered me to go get an MRI tomorrow Oct 24 and referred me to a orthopedic dr. When I called the orthopedic dr I was told I could not make an appointment until my HR department contacted them. I only talked to my HR department on friday morning and was told they would call me back. I left a message at the end of the day on Friday and then on Monday and on Tuesday after seeing my primary physician. I think that my claim is being handled the wrong way. I also think that my manager is trying to get me to come back into work even though I can barely walk. I am interested in a free consultation and am prepared to take legal action if I get denied treatment before the end of my work release. Thank you

You have a valid workers' comp claim and should file it immediately to put the employer on official notice, and also to establish your right to temporary disability benefits from the worker's comp insurer. Once the claim is filed, it will be assigned to a claims adjuster and medical review. Also, if he didn't already do so, your pcp should give you a sick slip keeping you off work to support your disability claim. Provide that and his ortho referral to HR and ask them to contact the ortho to approve the referral or to refer it to the comp claims adjuster.
