Legal Question in Workers Comp in Maryland
if out of work on a worker comp claim, when released to return to work my work said they had no work and had hired two new employees during the time i was out on comp. is that legal? it is my understanding that being as i have seniority over the two new employees that they would have to be laid off when i returned back to work.

Maryland does not guarantee that when a worker is out on Workers Comp that their job will be held for them. Contact a Maryland workers compensation attorney to discuss the specific details of your case as there may be other issues at play (such as a company policy, which states that the company must follow a "last in, first out" type policy, union membership, etc.).
