I was injured at work. I broke my l5-s1, and ruptured several disks. The l5-s1 was suricaly repaired. The disc have not been touched. The insurance agentcy knew that the disc needed attention yet have done nothing. Would the disc be considered an additional injury? Also can a suit be brought against the insurance comp for knowing that this injury is there and they have done nothing to correct it or even address the problem. I have a workers comp case at this time. It is to be setteled soon. But if this issue is not addressed, do I have any recourse ?

If the insurance company won't agree to pay for surgery or treatment for the discs, and your doctor recommends some treatment, you should seek a hearing before the workers' comp commission and ask the commissioner to order the insurer to provide for treatment. This is not handled in a lawsuit. Do NOT settle your case until this issue is resolved, or you will lose the right to these benefits.
