Legal Question in Workers Comp in Maryland
workman's comp
I was hurt on the job a month ago and will probably need surgery. I have been receiving my workman's comp. However, since I'm not getting a paycheck from my employer, my insurance, 401K and stock purchases are not being paid. What happens in that case? Also, the doctors that my employer sent me to didn't act quickly, resulting in my being out of work longer than I would have had to. Can I sue my employer for all the benefits I'm losing and for the difference in my salary that workman comp does not cover. Also, since the money sent by Workman's Comp does not have taxes taken out will I have to pay taxes on this income. Thanks

Unless your employer isn't followed established company procedure, you would not have a claim against him. However, you might take the position that those lost benefits are part of your overall compensation, and should be factored into your ongoing comp payments, which are not taxable.
