Legal Question in Workers Comp in Maryland

worksmans comp

My husband got hurt on the job and employer did not have worksman comp.He agreed to pay for hospital services and therapy. he got hurt on 4/02/07 got surgery and 2 months later he fell and re injured the same leg. His employer sais he was only going to pay him 6 months even though his doctor did not release him yet. The question is who is liable for this.

You didn't say how he reinjured himself. If this was unrelated to work, the employer is not going to be liable for any enhancement of the injury caused by the non-work fall. Of course if he had gone back to work and reinjured himself there, then the employer is responsible under workers' comp. Your husband needs to get a report from his doctor as to the relationship between his present condition and the job-related injury(ies).

If the employer is without coverage, there is a state fund that will cover the claim. He should consult with an experienced workers' comp attorney about all of this.
