Legal Question in Criminal Law in Massachusetts
Car Vandalization
My girlfriend ''m'' and my brothers girlfriend ''t'' are both being accused of vandalizing the car owned by the girl my brother has been cheating on ''t'' with. ''t'' is saying she saw ''m'' scratch the car up, but there is no further evidence. the police have been contacted, and told ''m'' that they were both going to be charged with a 5 year felony for the vandalism. i wanted to know if either were likely to be convicted, or if the police are trying to scare them into a confession?

I'm not sure I can figure out your scenario. Is there more than one "t"?. In any event, there is a possibility of conviction based on one person's testimony. It depends on credibility. Obviously, if anyone were to confess, the possibility of conviction becomes a probability. I would advise the girls to speak with an attorney before speaking with the police.

Before conviction there is an investigation, and arraignment.
These are charges usually brought in district court, and any conviction, if it does happen, is remote, and sentencing depends on many factors.
If the police is saying that this is an indictable offense leading to 5 years, this is probably nothing more than coercion.

Re: Car Vandalization
Do not speak to the police before speaking to an attorney. If neither woman has a record there is virtually no chance of any jail time. From the facts given in your question, there is also a very good chance of beating the case. A co-conspirator's confession after the fact can not be used against the other person. Speak to a lawyer first.
