A friends note book was being fixed at a local computor store. During this time the repair person noticed something to do with child porn. He called the local police and they took the notebook. question , do they need a warrant before they took it.

The short answer is yes based on the info you provided. However, there may be additional facts and/or circumstances which may allow a challenge to any search of the computer for evidence of a crime. Your friend should not be discussing the case with you. As a friend, you should tell him not to discuss any specifics with anyone but an attorney. Any statements he makes outside the attorney-client privilege may be used against him.

Rereading your question, I realize that my answer is confusing. Answer is, yes, police can take the laptop, and no, they do not need a warrant to take it. But like i said, additional facts may provide reasons for challenging a search of the computer.
